Claims against the Crown, Ex-Gratia Payments and Court Awards not related to Passport Canada

Depending on the claim type, the following supporting documents must accompany the request:

  • A memo, including a description of events, signed according to the Section 32 of the Financial Administration Act (FAA) by the person with the proper financial delegation (see table below);
  • The Requisition for Payment form Requisition for Payment (Canadian Funds) (FIN2865) (opens new window) including the complete financial coding, the funds commitment number and the delegated manager’s signature according to the Section 34 of the FAA;
  • A copy of the Court’s judgment for amounts awarded by the Court; or
  • A copy of the final agreement signed by all parties if the payment is the result of such agreement; or
  • A release which may take various forms (email from the employee confirming no further action will be taken or Appendix A), except when it would not be administratively expedient and the manager is confident that the payment will resolve the claim. For ex-gratia payments, a release is not normally required ;
  • Any other relevant documentation supporting the request (invoice, account statement, etc.).

Please note that a legal opinion must be obtained for all claims against the Crown over $25,000.
